PROOF SITE USAGE AGREEMENT
In using this site, you agree to the Terms and Conditions listed here. Hök Nik Creative Inc. may revise these Terms and Conditions at any time by updating this posting. You should visit this page periodically to review these Terms and Conditions, because they are binding on you as changed.

CLIENT DUE DILIGENCE
You unconditionally guarantee that any elements of text, graphics, photos, designs, trademarks, or other artwork or information furnished to us for use in the project are owned by you or your organization, or that you have permission from the rightful owner to use these elements. In the event of a copyright or trademark infringement, you will hold us harmless and protect and defend Hök Nik Creative Inc. and its subcontractors from any claim or suit arising from such action.

You acknowledge and agree that you are solely responsible for the form, content and accuracy of any Content you upload and/or post.

PROOFS
Corrections are to be made via web proof and returned via electronic means marked “OK” or “OK with changes” and signed by you the customer. If revised proofs are desired, request must be made when proofs are returned. We regret any errors that may occur through production undetected, but cannot be held responsible for errors if the work is printed/produced as per customer’s OK or if changes are communicated verbally. We shall not be responsible for errors if the customer has by-passed proof approvals, refused to accept proofs, failed to return proofs with indication of changes, or has instructed us to proceed without proofs.

ALTERATIONS AFTER SIGN OFF
Alterations represent work performed in addition to the original specifications. Such additional work shall be charged at current rates and be supported with documentation upon request.

DIGITAL FILE OWNERSHIP
All privileges, copyrights and licenses granted by our firm are transferred on the receipt of full payment of project costs. While you own the copyrighted artwork, we retain ownership of all digital source files in their native software required to complete your project. File transfers of artwork in its native file formats are billed for in addition to prices listed in this estimate.

PORTFOLIO
Unless specifically indicated otherwise by you, we may use this project in our portfolio and advertising materials after it has been released to the public.

THOUGH SHALL NOTs
Under no circumstances will you use the Site to:

1. upload, post, email, transmit or otherwise make available any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party ;
2. violate any law or otherwise engage in any unlawful activity ;
3. upload, post, email, transmit or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable ;
4. upload, post, email, transmit or otherwise make available any Content that you do not have a right to make available under any law or under contractual or fiduciary relationships ;
5. impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity ;
6. upload, post, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment ;
7. forge headers or otherwise manipulate identifiers in order to disguise the origin of any content transmitted through the Site;
